Q850:  What does it mean when the VA labels all my disabilities as static with a T&P 100% in nature with educational benefits for my spouse? Then the BVA judge changed it to TDIU SMC S, K. No mention of disabilities being static or educational benefits for my wife.

A1:  Why in the world would you have appealed a 100% P&T rating?  (RJ)  4/6/22

       

A2:  A static disability means your disability is considered "permanent." Total and Permanent means the VA won't mess with you if you don't mess with them. Anytime you see the educational benefits (Chapter 35), then you know you have a P&T overall rating. When you said the BVA judge changed it to TDIU, that doesn't make sense. You were P&T and TDIU is P&T. SMCs can be added anytime you have loss of use of something. That is an amount over the normal payment rate based on your percentage.  (DS)  4/6/22
