Q846:  I am a solid 90% with unemployability. Should I try for 100% disability? I am having more problems with my health due to health problems while in the military.

A1:  The question is why would you want too? You already get the same benefits as someone who is outright 100%. You are considered permanent and total right now. In other words, you don't mess with the VA and they won't mess with you. The only time I would recommend reopening your claim is if you have developed a disability that could cause your demise and are sure it is related to your military service. We have had veterans try this very thing and end up getting reduced by the VA because they find out they made an error or see where you haven't been getting medical treatment. At any rate, we have veterans sign a form acknowledging the fact that they could be reduced or severed if they haven't held the rating for 20 or more years.  (DS)  3/29/22

              

A2:  Depends. If you have a disability that will get you a single 100% then you have to go for it because it is worth an SMC for what is called housebound. If your number, however is a solid 90 then it would take a 50% issue either by increase or a new issue to get you there and monetarily nothing would change. The difference between 100% and IU is the fact that you can not work a substantial job without losing your IU at 100% you can (for VA purposes ) work of course your disabilities would probably keep that from happening.  (ST)  3/29/22

         

   

  

  

  

  

  

  

    

      

A3:  I think it depends on your representation.  Some VSOs secretly will not support the extra work, while others go all out for you.  Some VSOs will screw you over.  So this is risky.  You really need to consider the VSO you have if he/she really advocates for you.  If so, go for it.  If not, back off or find someone else.  (HC)  3/29/22
