Q803:  I been getting the run around for the last 10% that I need to be taken to the 100% level. I have two outstanding claims. I’ve been waiting for many years. Do you know of a way to speed up this matter? My hearing claim they continually to be denied me on. They say not service related. This is not being compared to my service duties as follows: Williams AFB Primary training for new pilots(I hear this was the largest training base with somewhere in the neiberhood of 1000 aircraft. How can they deny me when I continued in civilian life: hired on with GE, went to Saudi Arabia peace tiger program total F-5 approx. total F-5 was around 75 ( worked in flight line support no comparison to William AFB! After that I was promoted to a Field Service Rep.(Taiwan) I did more paper work noise level minimal, only produced one F-5 per month ( this was project with Northrup Aviation) now wait they can compare this to Williams AFB. Only delivered one aircraft per month. Again should not cause denial. It is no way what I was exposed to at will working Test Cell and trim pad, noise level very HIGH. Any suggestions?

A1:  There are several ways to have a VA claim expedited. (1) serious injury or illness resulting from military operations; and/or (2) terminal illness. You will need a doctor letter stating you what your terminal illness is and life expectancy.  You can also ask to have your claim expedited if you are 85 years of age or older.  Use a VA Form 20-10207.  If it is an appeal at the BVA, 75 years of age can get it expedited. You can also ask to have your claim expedited due to severe financial hardship.  Use a VA form 10-10HS for financial hardship.  (DS)  12/15/21

                 

A2:  The previous answer was correct as far as speeding up the process.

        

I would like to remind you that your hearing claim depends greatly on two factors. 1. Your entrance exam & 2. Your exit exam.

Part of the claim problem could possibly be that you told them you have worked on other air fields after service.

       

If your exit exam was close to normal and you have told them you worked on aircraft or on an air field after service, they will always blame the hearing loss on your post service occupation.

  

Something you did not tell was your age and how many years after service did you file for the hearing loss. This two is a way the VA will trip you up.

   

If you are 26 and filing a claim 6 months after discharge, you would stand a good chance. If your 85 and filing 50 years after discharge, you probably will be told your hearing loss is age related.

A3:  You are warned to be careful with the VA and the information you give them about work outside of your military service becasue they have a tendency to give that kind of work more weight.  (HV)  12/15/21

                              

A4:  When a claim is denied there are three routes open to you. One you can file a 20-0995 if you have new medical evidences for the denied claim. Second you can file a 20-0996 ask for a higher level review of the claim. Thirdly you can file a 10182 and ask for a hearing before a VA Law Judge. Most of the time as a VSO I file for hearing with the Judge and do a virtual hearing by computer and that is the most convenient way for me to do a hearing.  (GR)  12/29/21
