Q775:  I had kidney stones and was told that the urinary tract infections may have caused my immune system to be compromised and made me susceptible to getting multiple sclerosis which I was diagnosed with while I was in the VA hospital.  Am I eligible for compensation?

A1:  Good morning. That is certainly an unfortunate chain of events. First thing you will have to do is to make the claim to the VA and let them decide. You will have to spell out to the VA the chain of events resulting in MS. If I was your service officer, I would first file for service connection (SC) for the chronic kidney stones. Then file for chronic UTIs secondary to the kidney stones. Then you will have to file for SC for compromised immune system secondary to the chronic UTIs. And lastly, SC for MS secondary to the compromised immune system. If any of the claims fails to provide SC for any of your claimed conditions, then everything after the broken link will fail to gain SC. Like all claims with the VA, medical evidence is key. You will most likely need a nexus statement from your doctor laying out the chain of events tying everything backwards to the in-service event of chronic kidney stones.  (DS)  10/4/21

     

A2:   I think it's worth the work to file for a claim, but I will say I have filed for kidney stones several times and have been denied every time although from the time I was discharged I have had a kidney stone problem which continues today.  (AM)  10/5/21
