Q764:  If I am rated at 80% getting paid at 100% because of my disability.  If I pass away will my wife receive my 100%?  How long would she have to wait?

A1:  No, your wife will not receive your 100%. When a veteran dies, there are two programs the surviving spouse can be entitled to. The first is the Death Pension. This is an income dependent program and the veteran would have to have served 90 days of active duty with at least one day being during a period of war. A widow/er in fairly good health is only allowed to have $778 in income from all sources. There is a Housebound rate and an Aid & Attendance rate. The other program is Dependency & Indemnity Compensation (DIC). DIC is payable if the veteran dies of something they are service connected for, or should have been. If the veteran is 100% P&T for 10 years then the surviving spouse would also be entitled to DIC. If you are married for at least 8 of those years then they are entitled to the "Kicker" of an additional $288.27. There are also the Housebound and A&A rates for DIC, too.  (DS)  8/18/21
