Q751: Claims submitted in prior years for compensation for the newest 4 presumptive Agent Orange conditions were denied, but are now being granted. What should be the effective date? The original submission or the date they were added to the presumptive list?

A2: Since you were denied to even file a claim! And there's no date to look back on! I believe there should be a designated amount of time for the claim and done as soon as possible! (PG) 7/4/21
A3: There were three conditions, bladder cancer, hypothyroidism, and Parkinsonism or Parkinson's like tremors that were added to the list of presumptive diseases related to exposure to Agent Orange. Historically, the VA usually goes back to the original claim that was denied and gives an effective date, if allowed. Even on new claims for the disability, the VA has gone back to the earliest documentation of medical treatment and can use the date that would allow a grant of 10% or more. Like all things VA, there are laws that determine what date they will use, and sometimes, can be hard to interpret. (DS) 7/6/21
