Q746:  The VA and 3 VA doctors agreed with the same diagnosis of nerve damage due to toxic exposure, i.e. Agent Orange. They instructed me to file for disability as Parkinson's Like Tremors under Parkinson's disease.  Having done so, the VA has denied the claims over the past few years. Having refiled the claim, what should be the next step?

A1:  Prior to as little as a few months ago, Parkinson's like tremors was not on the list of Agent Orange conceded disabilities. Parkinson's like tremors, hypothyroidism, and bladder cancer was just added to the list. The VA will automatically do a re-evaluation under Nehmer. I would recommend to go ahead and file again on a VA Form 21-0995 and use the new VA law as your N&R evidence to relook at your claim. Unfortunately, if you claim is already on appeal, then it will have to wait it's place in line. Supplemental and new claims will be processed the quickest.  (DS)  6/28/21
