Q726: I just got approved for 40% service-connected disability pay. I’m not married, but my girlfriend and I have been together for 15 years and we have two young boys. Even though we are not officially married, can I claim all of them as dependents?

A1: Do you claim them as dependents on your taxes? if yes, you should also be able to claim them for VA compensation. The VSO who handled your recently-approved claim should know the answer. (DJ) 6/6/21
A2: The short answer is "no" unless your state still recognizes common law marriages. If you choose to adopt her children, they can be considered as your dependents. The VA also has a law in which you have to married to your spouse for one year before they would be entitled to receive any death benefits. (DS) 6/7/21
