Q659:  I recently had a second heart attack. The first one I received a 50% disability. Now that I’ve had a second heart attack what happens now with my disability rating?

A1:   I would file a 21-526ez and ask for an upgrade for ischemic heart disease give dates of second heart attack.  (GR)  2/7/21

    

A2:  See an Accredited VSO with the Am Legion, VFW, Am Vets, DAV or another Veterans Service Organization. They will explain your options. And you do have options.  (GH)  2/8/21

          

A3:  Nothing will happen to your disability rating until you file for an increase on a VA Form 21-526ez. Then the VA will schedule you for a C&P exam to determine the residuals. It is important to note that any time you file a claim with the VA they can do one of three things: increase your rating, continue your rating, or reduce you rating based off the results of your C&P exam. You might also consider getting a letter from you cardiologist providing their opinion on whether or not you should continue to work or not. If he/she says that they don't think you should work, then I would also file for TDIU because of your inability to obtain or maintain gainful employment.  (DS)  2/8/21

     

  

  

  

  

  

  

  

  

        

A4:  You can ask for a revaluation, however remember they can also reduce your rating by sending you for a Comp and Pen exam.  Check with your VSO for their input. If you are getting comp for other things it's all open for them yo review.  (ML)  2/8/21

      

A5:  Nothing will happen, you need to reapply. You earned it by defending your country. You can also call 1-800-827-1000, they are there to answer your questions. Never give up! Good luck!!!  (EA)  2/9/21

           

A6:   You have to file a claim because the VA will not do anything unless you file. The VA will diagnose you with PTSD and won't give a disability rating unless you file for PTSD.  Remember you have to file a claim for everything that's service connect.  (RI)  2/13/21
