Q636: I have been 100 percent total and permanent service connected for 8 years. Is it true after ten years my wife would get half of my benefit no matter how I die? If I die before the ten years I have to die from the disability in order for her to receive half my benefit?

A1: Partly true. Your spouse would not receive 1/2 your benefits. She would be awarded DIC, and if you were married for 8 of those 10 years prior to your passing, then she would also receive the kicker. There is also a provision for her receiving a Homebound benefit or Aid & Attendance, depending on her health status. (DS) 1/8/21
A2: Believe it is DIC she will get. Need to check DIC rates. It is not half but probably near that amount. Also, she should be getting CHAMPVA. (RC) 1/8/21
A3: Unfortunately no, disability payment is for the Veteran, and when he passes the disability stops. Now here the catcher, at 100% for ten then the surviving Spouse can file for Dependent identity Compensation which is referred to as DIC, that is about a third of what the Veteran received.
