Q634: I was engaged to a veteran for 16 years, and before we got married he had a stroke, and spent the last 4 years in the hospital, nursing home and at home with me taking care of him. Then he passes away. I just wanted to know is there any way I could get his pension since got married?

A1: If you were not legally married to the veteran for a year prior to his passing it is unlikely that you can get the death pension, providing he was a wartime veteran. Some states still recognize common law marriage. If you are in one of those states, I would seek out a Veteran Service Officer near you who can help you file for the death pension. (DS) 1/8/21
A2: Unfortunately when the Veteran passes away the disability payment ceases. If he had been rated at 100% you could qualify for the DIC. I know a lot of information is out there regarding benefits but it not all true as you need to know the qualifications for it. (GR) 1/8/21
A3: Sounds like you were a care taker. Go to veterans commission where you live and ask for what you need to do. (EA) 1/8/21
A4: No, you were not "legally" his dependant. (KD) 1/8/21
A5: Hello. You will not be eligible for "his pension" but you may be eligible for surviving spouse benefit. I would suggest you see a local VSO or DAV representative that can help you submit the paperwork. I am not sure of the exact amount for surviving spouse benefit at the current time. A6: My bet is No. Not married, there is no legal connection to you.
I suggest you contact an "S-O" who would know for sure. They are Service Officers that are Free and help all veterans get their benefits.
What I do know is:> If a Veteran gets a divorce, The divorced partner "Cannot Get That VA Compensation. Military Career Pension is like a job and that is different. Call and get an appointment with an "SO." (CS) 1/24/21
