Q620: I have a 30 year old son who is Downs Syndrome. He has been declared a helpless child by the VA immediately following his 18th birthday. I am 100% service connected. My question is, what can my wife expect to receive, after my passing, for herself and our son, and just as important what will my son be eligible for once we have both passed?

A1: Your wife would need to file a 21p-534 for the DIC and list your son as a dependent on that with the documentation that he is disabled. I would recommend that you appoint a fiduciary to handle his finances for him in case both of you pass away. (GR) 12/26/20
