Q616: What should be my effective claim date? I am BWN 1966 Wes PAC USS Constellation CVA 64. I was treated in sick bay on the USS Witek DD 848 for lung scars found on x-rays in 1967. 3 months after discharge in Dec. 69 I went to VA Hospital in Providence for check of lung disease. April 2013 I had quadruple bypass surgery. Because of BWN act I filed 526 EZ claim Sept 18, 2019 for IHD.

A1: The effective date of your compensation is the date the claim was filed with your pay date being the first of the following month. Now sometimes the VA will add another year to that with documentation.
Like they will ask for information to show that you had your disability before the claim was filed. (GR) 12/24/20
A2: Effective date of disability is when the claim is filed with the VA. (BM) 12/24/20
A3: I suggest you take any documents with you to the nearest VSO or DAV office. They will assist you, along with looking in your ebenefit file. It is sometimes difficult to figure out and going to a representative is the best way to go to get the correct answer. (RC) 12/24/20
A4: Date the VA RECEIVED YOUR CLAIM SHOULD BE YOURCLAIM DATE TILL YOU RECEIVE A DECISION, assigned a percentage of disability. Numerous replies to the VA have time lines to respond so make sure you meet those required responses. (DF) 12/24/20
A5: Typically when you first file your claim that is the date they used to determine when you start getting paid It does not go to when you found out about it but when you actually file the claim. (MW) 12/26/20
A6: Normally, effective dates for VA claims is the day that the VA receives the claim. In cases of Agent Orange conceded exposure claims, there can be different rules. VA will go back and look to see if there is some documented medical treatment that will support an earlier effective date for your claim. Believe it or not, but the VA is on your side and will look for that evidence. They do make errors on occasion so if you believe that the effective date is not correct, ask the VA to relook at it.
