Q267:  I served in infantry unit in Vietnam from 1966 - 1967.  During that time I sustained severe damage to both ears from the noise of gun battle and war. I applied for hearing loss in 1996 and the VA denied my claim without testing me for hearing loss.  I applied again for disability compensation in 2017 and was awarded 20%.  Shouldn’t the VA give me back pay from 1996 when I first applied?

A1:   If you had filed an appeal in 1996 and has continous prosecuted it until the appeal was heard then the VA would have paid you all the way back. The catch is if you go more than one year without procuteing and the when you file your time starts with the latest date. Now you could so 20-0995 which is a supplement claim and show a clear and unmistakable error was made in the original claim and go before the Judge and see what he said. He nat agree or he may not.
