Q247: Long story short, VA gave me a little of $50,000 in retro pay a year ago, now I get a letter saying they over paid me by $41,241 and will stop my disability compensation until debt is paid. How do I stop the VA from garnishing my disability compensation? I need the money to survive.

A1: You may not be able to stop it. The same thing happened to me. Just ask for a repayment plan. Agree to the lowest amount possible. (LL) 9/20/19

A3: Immediately file an appeal. This will stop all proceedings for at least a year. They are really slow responding to appeals. Then write your congressman or woman and senator. They must respond to them. Hope this helps. (CS) 9/20/19
A4: If you received the money if good faith, try applying for a 'Waiver of Indebtedness'. (DB) 9/20/19
A5: Write letters to your Congressman, Senators, VA Secretary, VA OIG, and the Vice President of the US. (MB) 9/20/19
A6: In one of the webinars Sec. Willie and one of the section heads talked about over payments. As I recall the decision in dealing with those payments were to forgive them and not require repayment

A9: Unusually do not respon d, however if I received a back payment from the VA for $50,000 plus, I would make sure everything was correct before I would touch it. Seems to be excessive ... I have received back payments but nothing in such an amount . Pay it back or your disability will be discontinued. Sorry, but you should have really questioned this before spending it. (CK) 9/20/19
