Q244:  I have a NOD that has been pending for 5 years. And a CUE is included in my claim. Normally how long does this type claim take to complete?

A1:  You have 365 days to file the NOD. They, VA RO, has as long as it take that could any where from 30 days to nearly forever. My case has been in the works since 2002 that is seventeen years and counting.   (DF)  9/16/19

     

A2:   I've been at it now for 15 years. Within the last 2 years my appeal was remanded back to my states Dept of Veteran Affair, twice by the U.S. Court of Appeals for Veterans Claims and now it's setting in front of a Veterans Law Judge ...... I've been waiting now for over 6 months.  (TC)  9/16/19

     

A3:  Even though they have "ramping", it does not appear to speed the process. I am at almost 10 years. I am at 90% and had my court hearing in February. It was remanded back to my regional VBA office and still waiting. I would suggest not using "NOD". Try using a "reconsideration". An " NOD", could effect your back time or restart the clock. Be patient and most importantly, don't give up.   (LE)  9/16/19

    

A4:  The NOD is a appeal and this takes 5 to 7 years to complete. As a VSO I have several that are 6 years and just had one done that was that long. There is no short cut once you go in the procedure.  (GR)  9/15/19
