Q150:  I have been denied medical for the migraines that I get.  I had a head injury while I was in the Navy. I'd like compensation for my head injury. My doctor cannot say for certain that my Navy injury caused it. But, he cannot say that it didn't. I have been evaluated through the VA.  And I was still denied. Even with an appeal. But, I'd like to see if I could still file a claim. Also, for my hearing. I have ringing, and it causes me loss of sleep. Any help would be deeply appreciated. Thank you.

A1:  If you are not already logged in, please log into eBenefits and MyHealtheVet A.S.A.P. !!!!! By doing so you will be able to file a new claim for all possible service connected disabilities you might be receiving services for through the VHA. DON'T bother with the VSO in the process because, with eBenefits, you can now take charge of your claim process.  Also, please consider making the DAV as your representative because you really want to have that 600 pound beast in your corner when it comes to working with the VBA.  (TB)  10/3/18

   

A2:  Tinnitus (ringing in the ears) is presumptive service-connected if you worked in the propulsion plant, around aircraft, or missiles or guns. A3:  Obtain your medical records from the DOD that shows or documents your initial head injury. The appeal or file a notice of disagreement as long as it?s within the year of your denial. You can always go to an outside physician and get that documented as additional evidence. Have him fill out a DBQ for you also. As far as your ear ringing ask your primary care doc at the VA refer you to an audiologist so you can be tested. Then once you have an official diagnosis you can file a claim for tinnitus. If you have hearing loss you can file a claim for that with the tinnitus as a secondary.  (MAC)  10/5/18

   

A4:  All you need to file tinnitus is a lay statement. You can diagnose yourself with tinnitus. As for the other issues, it is very difficult to reopen a claim once it has been denied and finalized. I would not recommend attempting to do this on your own. Seek assistance from the nearest DAV service office. They are trained to handle these cases. You can use eBenefits, but since you don't know the intricacies of the VA system and case law, you would be basically driving in the dark.  (AP)  10/12/18
